- Users of the Forever support services Ltd website are subject to these terms and conditions (the site). You accept and consent to these Forever support services Ltd terms and conditions by using this website. Any modifications to these terms and conditions shall be communicated to users in writing by Forever Support services Ltd.
- To avoid any misunderstanding, only the use of the site is covered by these terms and conditions.
- Forever support Services Ltd is the exclusive owner of all copyright in the content on the site, unless otherwise stated. The owners of each and every trademark, whether registered or unregistered, that is utilised on the site.
- Forever support Services Ltd grants you permission to print, copy, reproduce, download, and view the contents of the site so long as you use the information only for personal, non-commercial purposes and without altering it in any way.
The Contract
- These terms are the agreement between Forever support Services Ltd and the client for the provision of the worker's services. The client is deemed to have accepted these terms by requesting, interviewing, or engaging the worker and providing any information about the worker to a third party after an introduction.
- Except as expressly provided in a written document signed by [a director of] Forever support Services Ltd, these terms constitute the complete agreement between the parties. The client's terms of business or purchase conditions are superseded by these terms.
- No modification or alteration to these terms shall be effective unless agreed to in writing and signed by both Forever support Services Ltd and the client, with a copy of the modified terms sent to the client along with a date on or after which the modified terms shall take effect.
Charges/fees
- Per hour, Forever support Services Ltd will charge a fee for each employee. The client consents to pay the Forever support Services Ltd hourly rate as disclosed to and agreed upon with the Client. The hourly charges consist primarily of the worker's hourly rate but also include Forever support Services Ltd commission calculated as a percentage of the worker's hourly rate, employer's national Insurance contributions, and any travel, hotel, or other expenses that may have been agreed upon with the client or, if there is no such agreement, such expenses. The hourly charges are calculated according to the number of hours worked by the worker (to the nearest quarter hour). All of these fees and levies are subject to VAT, if applicable.
- No later than 14 days after the invoice date, full payment for the home assistance services rendered will be declared due and payable ("the due date"). An electronic bank transfer will be used for all payments.
Late payment
- 4.1. Forever support Services Ltd reserves the right to levy interest at a rate of 10% on any late sums until the whole amount is reimbursed in the event that a payment is not received in full by the due date.
Information to be provided
- Forever support Services Ltd shall inform the client of the identity of the worker, that the worker has the experience, training, qualifications, and any authorisation required by law or a professional body to work in the assignment, and whether the worker will be employed by Forever support Services Ltd under a service contract, an apprenticeship contract, or a service contract for service.
Timesheets
- The client shall sign Forever support Services Ltd's timesheet at the conclusion of each week of an assignment (or at the conclusion of the assignment when it is for a period of one week or less) to confirm the number of hours worked by the worker during that week.
- The client's signature on the timesheet serves as proof of the hours performed. The client shall notify Forever support Services Ltd as soon as is practically possible and shall cooperate fully and promptly with Forever support Services Ltd to enable Forever support Services Ltd to determine what hours if any, were worked by the worker. If the client is unable to sign a timesheet produced for authentication by the worker because the Client disputes the hours claimed. The client is still obligated to pay the costs in relation to the hours worked even if they do not sign the time sheet.
- On the grounds that he is unhappy with the work completed by the worker, the client will not be permitted to refuse to sign a timesheet. The provisions of the following clause should be used in instances of unacceptable work by the client.
Payment of the Worker
In accordance with sections 44-47 of the Income Tax (Earnings and Pensions) Act of
2003,Forever support Services Ltd is responsible for paying the worker and, as necessary, for the deduction and payment of National Insurance Contributions and PAYE Income Tax applicable to the worker.
